Duke Hoax: Day #212

"The silence of North Carolina's political and legal establishment regarding Nifong's misconduct is stunning" - KC Johnson
Updated - Today's items:

KC JohnsonJamie Glazov, FrontpageMagazine.com:
Duke's Rush to Judgement — Frontpage Interview's guest today is KC Johnson, a professor of history at Brooklyn College and the CUNY Graduate Center...He writes a blog, Durham-in-Wonderland, which offers comments and analysis about the Duke/Nifong case....
Johnson: This is the story of how a case virtually devoid of evidence, constructed upon a tissue of procedural irregularities, nonetheless has lurched forward...

FP: Let's talk about District Attorney Mike Nifong's conduct...

Johnson: Nifong's conduct in this case is the most unethical of any district attorney I have ever seen...

Legally, the outcome of the case very much depends on the judge, Osmond Smith. Any judge with integrity would have to suppress the procedurally improper line-up ordered by Nifong and then used to indict the three players...

Duke, as an institution, has revealed a hollow moral core. Seven months into a case of what might be the highest-profile example of prosecutorial misconduct in the last decade, two Duke law professors and two Duke arts and sciences professors have publicly criticized Nifong. Meanwhile, Group of 88 members continues to defend their actions, even to the point of making demonstrably false public assertions about the players...

Michael Gaynor:
Greta Highlights Need to Change Venue — If a fact witness is so easily intimidated, imagine what pressure to convict would be put on jurors, especially black jurors!
Move to Dismiss NOW — Judge Smith should grant the motion [ID Suppression], and thereby invite a motion to dismiss...

Joan Foster, LieStoppers:
No, Amanda, He Used Her — Because Nifong used her, alleged victims are now accusers and media panels speak of the expectation of returning to the practice of naming accusers publicly...We'll remember the manipulation of "FACTS" and the rush to judgment in Durham. We'll remember how revered groups like the NAACP seemed to suspend many standards of justice they have nobly stood for over generations...Every true rape victim going forward will, in her own way, be another victim of this Hoax...

John in Carolina:
Advice for Prof. Crowley — If before he sent those sentences off to the Herald Sun Crowley had asked my advice, I’d have told him something like the following:....You’re opening yourself up to criticism with your Nifong was “swept away by a tidal wave of media attention” claim...

KC Johnson:
Legal Analysis by Thomas J. Crowley, Esq.Crowley, whose academic training is in geology and whose research speciality is earth systems science, then proceeded to produce a column that combined errors of fact derived from insufficient knowledge about the case with a faulty legal analysis flowing, presumably, from his own lack of legal qualifications...Crowley went out of his way to condemn both the players and their attorneys—even if he had to invent facts to do so...Duke professors seem to have no problem in going public with even their wildest and most unsubstantiated allegations to continue their condemnation of the lacrosse players...

Potted OzYesterday (11/15):

Michael F. McCusker, Crystal Mess:
Oz in Wonderland: You've Got To Move. — Dear Judge Smith: ...Judge Orlando Hudson noted that having one person (that would be you) at the helm "would make it easier to have motions and hearings." That was three months ago....will you continue to underwhelm? You've got to move, Oz. It is time. Time to define your place in history. Have you the brain, the heart, the courage?

David Kane, EphBlog:
Phantom Call — Former Williams professor KC Johnson has a brutal takedown of former Williams professor Grant Farred....

Michael Gaynor:
Duke geology prof throws rocks at Duke Three — Why did Thomas Crowley, a Duke University geology professor, recently not only object to pre-trial dismissal, but also blithely ignore pertinent facts and law requiring it and instead spread misinformation (in conclusory terms), offer excuses for Mr. Nifong and accuser Crystal Gail Mangum and speculate wildly that the Duke Three and their attorneys are the villains in the Duke case?
TalkLeft discussion - Crowley's full of hot air

John in Carolina:
Here's another Duke prof — ...aren’t we lucky to have a Duke professor with “no preconditioned preference” regarding guilt or innocence point out there are what he calls "before and after" photos but none during “the alleged event ...Besides fooling himself regarding having "no preconditioned preference," do you think Professor Crowley fooled anyone else...Where does Duke find such professors?

Philip Wood, LieStoppers:
Crowley's Full of Hot Air — [see comments]

Thomas Crowley, professor of earth sciences, publicly soiled himself with a guest column in the Herald-Sun.

Thomas Crowley (Duke professor) - guest columnist, Herald-Sun (11/14):
Don't be too quick to toss lacrosse case — I am surprised at the number of letter writers to your paper who, although they have no legal qualifications, seem to assume they have sufficient knowledge about the Duke lacrosse case to conclude that the case should be thrown out before it even goes to trial. I don't know what happened that night with respect to those students and that woman, but I do know the following items about the case that would lead one to hesitate before throwing out the case....
