Duke Lacrosse Scandal: Say "Uncle" Dammit!

Mike Nifong Mike Nifong is like the pissant little brother who you hold down and pummel like a rag doll, but he won't say "uncle."

Almost every legal expert in the media, who has looked at the evidence in this case, is now saying he should drop the charges against the three Duke lacrosse players or else show his "smoking gun."

What do they know. Mike Nifong doesn't give a damn.

The News & Observer reports

In their every court filing, attorneys for three Duke University lacrosse players appear to open a new front in their relentless assault on the prosecution, challenging District Attorney Mike Nifong to defend his decision to charge their clients with rape.

While Nifong has yet to respond - either formally in court or in the public square - there is no indication the waves of defense motions has dented his resolve to bring the case to trial.

"If he is convinced of the truth of the charges, he has every right to pursue it, even if it's an uphill battle," said Steve Cron, a criminal defense attorney of 32 years who practices in Santa Monica, Calif., and has represented several celebrity defendants.

"If he is convinced the that the charges aren't meritorious, it's his constitutional obligation to dismiss the charges regardless of what pressure he gets from local police or media or the population. That's irrelevant to his decision. It is simply about seeking justice and that's his obligation to pursue it."

I don’t know about the rest of you but, my observation of our current legal system is that it’s not only broken—it’s imminently dangerous. If all it takes, for the complete destruction of lives, is a DA wanting to “get you” for his or her own political advantage (having no evidence whatsoever) we are in more trouble than we’ve ever been. One would think that, as this is an extremely high-profile case, Nifong would have been more careful. But as too many politicians seem to think these days, neither the law nor ethics matter anymore. Gaining the illusion of power is all that’s important. Perhaps Nifong has simply been blinded by the shining gold ring of political influence.
